Fiancé Category 

This category applies to persons who are engaged to South African citizens or permanent residents. These persons can be divided into groups. Thos who are considered to be acceptable in their own right and those whose application may be considered by the committee of the Immigrant Selection Board on submission of a marriage certificate.

Applicants on this category must apply and await for the outcome of their application abroad. In cases wherein the applicant has to go to South Africa for purposes of getting married and to await for the outcome of his/her application in South Africa, he/she must apply for a visitor's visa through this office at least forty five (45) days prior to his/her desired departure for South Africa. The application has to be referred to Head Office for approval and requires a waiting period of 4 weeks. He/she will then be required to pay a refundable repatriation deposit of US$2,000.00  Those who does not have the intention to join fiancé in South Africa and will wait for the outcome of their application abroad will be required to pay a refundable immigration fee of US$1,790.00.

Refunds can be applied through this office or the nearest Department of Home Affairs in South Africa upon presentation of a marriage certificate and the original receipt.

Employment is prohibited in South Africa until the application for permanent residence is finalized.

Important

All documents must be submitted in originals or notarized copies. Documents which are not in English must be accompanied by certified translations into English.

All fees must be paid in certified bank check payable to the South African Consulate General, New York.

A personal/telephonic interview is required towards the final stage of the application provided that all the requirements have been duly complied with by the applicant.

Requirements

Applicant:

  • Form BI 947 Application for Permanent Residence
  • Form BI 757E Preliminary Immigration Questionnaire
  • Form BI 939 Citizenship Declaration
  • Form BI 811 Medical Report
  • Form BI 806 Radiological Report
  • Form IM 418 Questionnaire
  • Letter of Intent re marriage
  • Two (2) Passport size photographs
  • Details of education, training and work experience (resumé)
  • Birth Certificate
  • Death Certificate (if a widow(er))
  • Final Divorce Decree (if divorced)
  • Valid Passport
  • Statutory Declaration (change of name, surname and date of birth)
  • FBI Report
  • Police Reports from countries where applicant has resided for a period of 12 months
  • Immigration fee of US$1,790.00 or Repatriation Deposit of US$2,000.00

The following documents are requested in respect of the fiancé who is a South African citizen or permanent resident:

  • Form IM 407 Sponsorship
  • Birth Certificate
  • Identity Document
  • Certificate of Naturalization (if a naturalized South African citizen)
  • Immigration Permit (if a permanent resident)
  • Confirmation of employment stating position, salary and period of employment
  • Offer of employment or employment contract (if to be employed)
  • Documentary proof of funds
  • Details of education, training and work experience (resumé)
  • Valid Passport
